These terms explain how Track Surgery may be used by doctors, clinical teams, and authorized users.
1. About Track Surgery
Track Surgery is a software platform that helps surgical teams collect patient-reported survey responses, monitor recovery trends, and manage follow-up workflows. The platform includes a physician dashboard and a patient-facing survey experience.
Track Surgery is not an emergency service, medical device, diagnosis tool, or replacement for professional clinical judgement. Doctors and clinical teams remain responsible for all medical decisions, patient communication, treatment plans, and follow-up actions.
2. Eligibility and accounts
The physician dashboard is intended for doctors, clinical teams, hospitals, or authorized administrative users. You must provide accurate account information and keep login credentials secure.
Patients access surveys with a doctor-issued patient ID. Track Surgery is designed to avoid collecting sensitive patient identity data directly from patients. Doctors are responsible for managing patient labels and matching those labels to their own internal records where needed.
3. Subscriptions, billing, and plans
The Free plan includes up to 3 patients, unlimited survey data for those patients, dashboard access, supported questionnaires, and CSV export. The Professional plan includes unlimited patients, unlimited responses and historical data, unlimited follow-up time, all analytics, and export all data.
Paid subscriptions may be billed monthly unless otherwise agreed. Prices, plan limits, and features may change, but active customers will be notified when a material pricing or feature change affects their subscription.
You are responsible for all applicable taxes and payment details. If payment fails, access to paid features may be limited until payment is resolved.
4. Acceptable use
You agree not to misuse the platform, attempt unauthorized access, interfere with platform security, upload unlawful content, reverse engineer the service, or use Track Surgery to violate patient privacy or applicable law.
You must not use the platform for urgent or emergency communication. If a patient needs urgent medical care, they should contact emergency services or their clinical provider through the appropriate channels.
5. Clinical content and survey data
Track Surgery supports validated questionnaires and procedure-specific outcome tracking. Survey scoring, interpretation, and clinical use must be reviewed by qualified healthcare professionals.
The platform stores questionnaire answers at question level so doctors can analyze symptom trends, satisfaction, quality of life, BMI changes where applicable, and other submitted outcomes over time.
6. Data export, retention, and deletion
Doctors can export patient labels, survey assignments, responses, messages, and related dashboard data where available. Exported files are the responsibility of the account holder once downloaded.
Account deletion may remove or disable access to account data, subject to backups, legal obligations, audit requirements, billing records, and technical retention periods. If you need a specific deletion or export request, contact support before closing the account.
7. Availability and changes
We aim to provide a reliable service, but we do not guarantee uninterrupted or error-free availability. Maintenance, updates, hosting issues, network problems, or third-party service failures may affect access.
We may update features, surveys, charts, and workflows to improve the product, comply with legal requirements, or maintain platform security.
8. Third-party services
Track Surgery may rely on third-party infrastructure and service providers for hosting, database storage, analytics, payments, email, and push notifications. These providers are used only as needed to operate and secure the platform.
Payment processing, if enabled, may be handled by a third-party payment provider. Track Surgery should not store full card numbers on its own servers.
9. Intellectual property
Track Surgery, its interface, software, brand, dashboards, workflows, and documentation are owned by Track Surgery or its licensors. You may use the platform only as permitted by these terms.
You retain responsibility for data you enter or submit to the platform. You grant Track Surgery the limited rights needed to host, process, transmit, display, export, and secure that data as part of providing the service.
10. Limitation of liability
To the maximum extent permitted by law, Track Surgery is provided “as is” and “as available”. We are not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages.
Nothing in these terms limits liability where it cannot legally be limited, including liability for fraud, intentional misconduct, or rights that cannot be waived under applicable law.
11. Termination
You may stop using the service at any time. We may suspend or terminate access if you breach these terms, fail to pay applicable fees, create security risk, or use the platform unlawfully.
After termination, some provisions continue to apply, including intellectual property, data handling, payment obligations, disclaimers, limitation of liability, and legal compliance terms.
